Instill Waiheke is a small-batch skincare business based on Waiheke Island, New Zealand, producing natural face and body care products using botanicals grown, harvested and distilled by us, alongside ethically sourced ingredients. These Terms apply to all use of this website and to all orders placed with us, whether by individual customers or businesses (e.g. stockists), within New Zealand or internationally. Please read these Terms of Service ("Terms") carefully before using this website or purchasing any products from us. By accessing this website or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use this website.

You may use this website for lawful purposes only. You agree not to:

- use the website in any way that breaches applicable New Zealand or international law;

- attempt to gain unauthorised access to our systems or interfere with the website's operation;

- copy, reproduce, or exploit any content from this website (including text, images, product formulations, branding, and photography) without our prior written consent.

We may update, suspend, or discontinue any part of this website at any time without notice.

1.1 We take care to describe our products, ingredients and their intended benefits as accurately as possible. However, because many of our products are handcrafted in small batches from natural, seasonal botanicals, slight variations in colour, scent, texture and consistency between batches are normal and are not considered faults.

1.2 Product images are for illustrative purposes; actual products may vary slightly in appearance.

1.3 Our products are cosmetic skincare products only. They are not intended to diagnose, treat, cure, or prevent any medical condition and are not a substitute for professional medical advice.

1.4 Patch testing and allergies: As with any natural or botanical product, individual skin reactions can occur. We strongly recommend performing a patch test on a small area of skin at least 24–48 hours before first use. If you have known allergies, sensitive skin, are pregnant or breastfeeding, or have a pre-existing skin condition, please review the full ingredient list and consult a medical professional before use. Discontinue use immediately if irritation occurs.

1.5 Full ingredient lists are provided on product packaging and/or product pages. It is your responsibility to check ingredients against any known allergies or sensitivities before purchase and use.

2.1 By placing an order, you are making an offer to purchase products, which we may accept or decline (for example, where stock is limited due to small-batch production, or where an order appears fraudulent or erroneous).

2.2 We will confirm acceptance of your order by email or other confirmation. A contract is formed only once we confirm your order.

2.3 All prices are listed in New Zealand dollars (NZD) and, unless stated otherwise are exclusive of GST where applicable. Shipping costs are additional and shown at checkout.

2.4 We reserve the right to correct pricing or listing errors at any time before an order is confirmed, and to cancel any order affected by a pricing or stock error, with a full refund.

2.5 Payment must be received in full before an order is dispatched, via the payment methods offered at checkout.

3.1 We aim to dispatch orders within 10 business days, noting that small-batch and made-to-order items may take longer; estimated timeframes will be provided at checkout or by email.

3.2 Delivery timeframes provided by us or by our couriers are estimates only and not guaranteed. We are not liable for delays caused by courier services, customs, or circumstances outside our reasonable control.

3.3 Risk in the products passes to you once they are delivered to the address provided at checkout. Please ensure your delivery details are accurate.

3.4 International shipping is not standard, but if agreed to, may be subject to customs duties, taxes, or import restrictions, which are your responsibility.

4.1 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, to the extent those Acts apply to your purchase.

4.2 Due to the personal and cosmetic nature of our products, for hygiene reasons we cannot accept returns or offer refunds for change of mind on opened or used products, except as required by law.

4.3 If a product is faulty, damaged in transit, or significantly different from its description, please contact us at paola@pandpdashwood.com within 2 days of receipt, with your order details and photos where relevant, and we will arrange a repair, replacement, or refund in accordance with New Zealand consumer law.

4.4 Custom or made-to-order items may not be eligible for change-of-mind returns.

5. All content on this website including text, product formulations, photography, logos, and the Instill Waiheke name and branding is owned by or licensed to us and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use this content commercially without our prior written permission.

6.1 To the maximum extent permitted by law, we exclude all liability for any indirect, incidental, or consequential loss arising from your use of this website or our products.

6.2 Where you are acquiring products for the purposes of a business (as defined under the Consumer Guarantees Act 1993), the guarantees under that Act do not apply, and our liability is limited to the value of the products purchased.

6.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under New Zealand law.

7. We collect and handle personal information in accordance with our Privacy Policy and the Privacy Act 2020. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

8. We may update these Terms from time to time. The updated version will be posted on this website with a revised "last updated" date. Continued use of the website or ordering of products after changes take effect constitutes acceptance of the updated Terms.

9. These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
